Privacy and Personal Information Protection Policy

This Privacy and Personal Information Policy describes the current policies and practices of Talisman Theatre ("Talisman", "we", "us", "our") with respect to the collection, use and retention of personal information that we collect directly from you through our website, our performances, our internships, or benefits, collectively referred to as the "Services" or your use of the Services or the Website (the "Use").

This policy also applies, with the necessary adjustments, to any file compiled by Talisman on any principal or supplier in the context of an employer-employee and customer-supplier relationship.

1. Introduction

Your privacy is important to us.

This Privacy Policy describes Talisman's current policies and practices relating to the collection, use and retention of personal information that we collect directly from you through our Services and your use of those Services.

The purpose of this policy is to meet the requirements of the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1) and other applicable laws and standards regarding the collection, retention, use, communication, protection and access to personal information.

For the purposes of this policy, the expression "personal information" means any information concerning an individual that makes it possible to identify him or her directly or indirectly, such as his or her street address, e-mail address, telephone number and any information of a medical or financial nature.

2. Collection of personal information

When you use the Tools and depending on your use, we may collect, where applicable, the following personal information about you ("Personal Information"):
- Gender;
- Last name;
- First name;
- Street address;
- Zip code;
- E-mail address;
- Telephone number;
- Payment information you provide to use the Services (including your payment card number, expiry date and CVV code);
- Internet Protocol address (IP address);
- Unique identification number issued by a government authority.

The Personal Information we collect is gathered by us or our service providers, notably through forms and through the interactivity established between you and our Tools. As indicated in the following sections, we also use cookies and information provided by our social networks.

We collect, use and disclose your Personal Information primarily through the following means:
- Your subscription to our newsletters;
- Order and donation forms on our websites;
- Google forms;
- Google Analytics;
- Facebook tracking;
- Comments you leave on our social networks;
- Correspondence with us.

We use the Personal Information thus collected for the following purposes, whether via our Tools or third-party suppliers' services:
- To proceed with the reservation or purchase when you obtain subscriptions, tickets to shows and events or products and services we offer and to inform you in this regard;
- To establish and confirm your identity;
- To respond to your requests for information, deliver products and services, maintain the quality of our customer service and prevent fraud?
- To target your needs, interests and preferences and inform you of our programming, news, services, benefits, products and goods that may be of interest to you;
- For statistical and marketing purposes;
- To manage our websites, social networks and ticketing services;
- For any other purposes permitted or required by law.

3. Information related to cookies

We use cookies to improve the performance of our Tools and your experience. Cookies are small files stored on your hard drive by the server on which the Tools are located or by third-party servers, which make it possible to recognize a user of the Tools and personalize their content.

Cookies, which may also sometimes be referred to as HTML cookies, are used for navigation purposes and to facilitate your access to and use of the Tools. They are necessary for the transmission of communications or to provide the services you have requested. The use of cookies enables safe and efficient use of our Tools.

Specifically, we may use cookies to:
- Collect information for the duration of your visit to our Tools;
- Collect information to recognize your browser or device on each visit;
- Analyze your behavior on our Tools so that we can continue to improve them;

We also use cookies that are retransmitted by an analytics or statistics service provider to collect aggregate information about the number of users and how they use our Tools. These are also considered third-party cookies.

The analysis or statistics service may collect information through log data, such as:
- IP address;
- Browser and device type;
- Operating system;
- Country information;
- Date and time of visit;
- Internet page of origin (referral) and exit;
- Number of clicks.

We do not use this information to identify you, but rather to understand trends in the use of our Tools and to improve our Services.

You can prevent these cookies from being stored by configuring your browser software. However, deleting cookies from your browser may remove any preferences you have set for our Tools, as well as any preferences you have set for other websites operated by third parties.

4. Information provided on social networks

We collect information transmitted by social networking sites or applications when a visitor interacts with profiles owned or controlled by us on these social networking platforms. These sites or applications are governed by their own policies relating to your personal information, which may differ from ours and may also be applicable.

If you choose to interact with us through these social networks, you should first read the terms of service and privacy policies of these third-party service providers and the applications used to access them.

5. Hosting of personal information

For the duration of your use of the Tools, your personal information may be transferred, processed and stored outside Quebec through the services offered to us by the following providers:
- AWS
- Google
- Mailchimp
- Square
- Stripe
- Zeffy

6. Duration of retention of personal information

We will retain in our systems all Personal Information collected for the duration of your use of our Tools and we undertake to destroy it at your request or at the end of your Use of the Tools.

7. Security

We ensure that the Personal Information we collect is kept in a secure environment. Persons working for us or on our behalf are required to respect the confidentiality of your information. To ensure the security of your Personal Information, we use the following measures:
- SSL protocol;
- SET protocol;
- Access management - authorized person;
- Access management - person concerned;
- Computer backup;
- Firewall.

We are committed to maintaining a high level of confidentiality by integrating best practices to ensure the privacy of your transactions. However, since no mechanism offers maximum security, there is always some degree of risk involved in using the Internet to transmit Personal Information.

8. Unwanted messages

We comply with current legislation and regulations regarding unwanted electronic messages (spam). If you no longer wish to receive electronic communications from us or if you consider that you have received an inappropriate or undesirable communication, please follow the unsubscribe mechanism found in our electronic messages.

However, we may still contact our users regarding their orders, requests for information or personal information, all in accordance with applicable laws.

9. Person responsible for the protection of personal information

The Privacy Officer is responsible for determining the purposes and means of processing Personal Information.

The person responsible for the protection of Personal Information undertakes to protect the Personal Information collected, not to transmit it to third parties without your specific knowledge or that of the present policy, and to respect the purposes for which the information was collected.

In addition, the person responsible for the protection of Personal Information undertakes to notify you in the event of rectification or deletion of Personal Information, unless this would entail disproportionate formalities, costs or steps for us.

In the event that the integrity, confidentiality or security of your Personal Information is compromised, the person responsible for the protection of Personal Information undertakes to inform you by any commercially reasonable means.

10. Right of objection and withdrawal

We undertake to offer you the right to object to and withdraw your Personal Information.

The right to object is understood to be the possibility offered to individuals to refuse that their Personal Information be used for certain purposes mentioned at the time of collection.

The right of withdrawal is understood to be the possibility offered to individuals to request that their Personal Information no longer appear, for example, in our registers.

We are also committed to granting a right of access and rectification or withdrawal to data subjects who wish to consult, modify or delete information concerning them.

11. Additional rights under European Regulation 2016/679

In accordance with European regulations concerning the processing of personal information, you also have the rights listed below.

In order for the person responsible for the protection of Personal Information to grant your request, you are required to communicate: your first and last name as well as your e-mail address, and if relevant, your account number or personal space or subscriber number.

The data controller is obliged to reply within a maximum of thirty (30) days.

a) Right to portability of personal information

You have the right to request the portability of your personal information, held by us, to another site, by sending a written request to the person responsible for the protection of Personal Information.

b) Right not to be subject to a decision based exclusively on an automated process

In accordance with the provisions of European Regulation 2016/679, you have the right not to be subject to a decision based exclusively on an automated process if the decision produces legal effects concerning you or significantly affects you in a similar way.

c) Right to contact the competent authority

In the event that the person responsible for the protection of Personal Information decides not to respond to your request and you wish to contest this decision, or if you believe that one of your rights listed above has been infringed, you have the right to refer the matter to any competent court.

12. Links to other services

The Tools may contain hyperlinks to third party websites ("Third Party Sites") that may take you away from the Tools. We provide these hyperlinks to enhance the usability of our Tools. The Third Party Sites are not under our control. As such, we have no control over the privacy and confidentiality practices of Third Party Sites. As a result, any personal information that is transmitted through Third Party Sites is subject to the privacy policies of those Third Party Sites. It is your responsibility to become familiar with these policies to ensure the protection of your personal information.

Please also note that this policy does not apply to personal information collected by the device (or its manufacturer) from which you use the Tools.

13. Policy modification conditions

We reserve the right to modify this policy in order to ensure its compliance with applicable law. Consequently, you are invited to consult it regularly to keep abreast of the latest changes. However, in the event of substantial modifications to the present policy, you will be informed by means of a newsletter to this effect.

14. Acceptance of the Policy

By using our Tools, you acknowledge that you have read and understood this Policy and agree to its terms, particularly with respect to the collection and processing of your Personal Information and the use of cookies.

15. Legislation and Commission for Access to Information

We undertake to comply with the legislative provisions set out in the Act respecting the protection of personal information in the private sector (RLRQ c. P-39.1).

If you are not satisfied with the way we respond to your requests or questions regarding the collection, retention, use or disclosure of your personal information, you may contact the Commission d'accès à l'information, a public body responsible for overseeing personal information practices in the private sector.
